Anambra State Public Procurement and Local Enterprise Participation Bill

Purpose

To improve the ability of qualified local businesses to compete for and win public procurement opportunities, within the bounds of applicable procurement law.

Problem Statement

Local businesses are frequently excluded from public procurement opportunities by information gaps, bonding and pre-qualification barriers, and limited capacity to prepare competitive bids, not by lack of capability.

Legislative Objectives

• Improve local-business awareness of public procurement opportunities.
• Provide capacity support for bid preparation and pre-qualification.
• Establish mechanisms, consistent with applicable procurement law, to encourage local-enterprise participation.

Definitions

Qualified Local Business

A registered business based in or substantially operating within Anambra State that meets applicable procurement pre-qualification standards.

Proposed Provisions

1. 1.A public procurement-opportunity information channel targeted at Qualified Local Businesses.
2. 2.Bid-preparation and pre-qualification capacity-building support, delivered in coordination with the Local Enterprise Development Bill.
3. 3.A review of lawful mechanisms to encourage local-enterprise participation, consistent with the Public Procurement Act and applicable State procurement law.

Institutional Responsibilities

• Relevant Bureau of Public Procurement and State procurement authorities to operate the statewide procurement-information channel.
• Office of the Member representing Nnewi South I to promote local business awareness.

Financing Implications

Primarily an information and capacity-building programme with modest direct cost; does not alter procurement value for money requirements under applicable law.

Implementation Mechanism

Information channel and capacity-building support launched in 2027–2028, aligned with the Local Enterprise Development Bill rollout.

Monitoring Mechanism

Tracked under the Business category of the Accountability Dashboard.

Expected Outcomes

• More Qualified Local Businesses aware of and able to bid for relevant public procurement.
• Increased local retention of public expenditure, within lawful procurement processes.

Legal Considerations

This proposal is intended to operate within the legislative competence of the Anambra State House of Assembly and in conformity with applicable federal law, including the Constitution of the Federal Republic of Nigeria, the Land Use Act, the Public Procurement Act and relevant sector legislation. Final drafting will be reviewed by legislative counsel prior to introduction. Any local-participation mechanism must remain fully consistent with the Public Procurement Act 2007 and applicable Anambra State procurement law and will not override open, competitive, value-for-money procurement requirements.
